Terms and Conditions of this agreement

1. Method of Payment 

All work will be paid for in ash upon completion of job unless credit arrangements have been made prior to the original service call..

2. Bad Check Charge 

Any dishonored check or bank draft will be charged a processing fee of $25.00 in addition to the total on the reverse and customer agrees to pay this processing fee if the check or draft is not paid for any reason.

3. Collection Fees 

The customer agrees that in the event this service invoice is placed in the hands of an agency or attorney for collection  or  legal  action,  the  customer will pay  an  additional  charge  in an  amount  equal  to  the  cost  of collection  including  agency  and  attorney  fees  and  count  costs  incurred  and permitted  by  law  governing these transactions.

4. Service Call

A service call is a call to the job address by a qualified service technician at the request of the customer. The service call is based on the time required to travel to the customer’ s house and the time required to analyze the problem and prepare an estimate of labor and parts required to repair the unit. If the customer does not want the unit repaired after the service technician has arrived in response to the call for service or after the estimate is given, the firm is still entitled to be paid for sending the technician and the service call charges.

5. Repairs 

Repairs are in addition to the service call. Repairs include labor and parts to repair the unit. After repairs are completed on the unit, turn it on to see if it is operating to your satisfaction. 

6. Parts

Parts  used-in  the  repair  of  your  unit  are  equal  to  or  superior  to the original  parts  used  in  your  unit.  Only parts  and  labor  listed  on this invoice  are  covered  by  our  warranty If  parts  listed  on  this  invoice fail  during the  warranty  period,  they  will  be  replaced  without  charge for  the  parts. Customer  will  pay  for  all  handling costs  incurred  to obtain  and  replace  these  parts.  If  any  other  parts  break  down  due to use  or  age  for  any reason  beyond  our  control,  the  regular  price  for replacing  these  parts  and labor  will  be  charged.  All  costs incurred to obtain parts to honor valid manufacturer’ s parts warranties will be charged for and paid by the customer. Since these parts are subject to availability from the manufacturer, we cannot guarantee the time it will take to obtain these parts. Parts purchased separately / over-the-counter have a  15 day money back return. After 15 days there is a 25% restocking fee. In no event will shipping or handling be refunded. We do not return electrical or special order parts.

7. Intermittent Condition

There  is  absolutely  no  labor  warranty  on  any  unit  with  an  intermittent  problem.  Since  the  problem  is  not always  apparent,  it cannot  be  traced.  The  only  lime  such  a  problem  can be  traced  is when  the  problem actually exists.

8. Limitation of Damages

In  the  event  the  repairs  are  not  successful  our  liability  for  damages including  consequential  damages  is limited to the amount actually paid by the customer.

9. Warranty / Service Contract Liability Release

This repair will be made for due consideration. I confirm that this repair will be paid for by the manufacturer warranty / service agreement. I agree that my liability for the cost of this repair is not waived and agree to be personally  responsible  for  the  cost  of  this  repair  in  the  event  the manufacturer  /  service  contract company / extended warranty provider fails to pay any portion of the full amount of these charges based on warranty limitations, or if the warranty provider fails to pay any portion of the full amount of these charges based  on  warranty  limitations,  or  if the  warranty  provider  fails  to make  payment.  In  the  event  that  I  am directly billed for all or a portion of the cost of this repair, I agree that I will remit said charges within 10 days of  the  billing  date,  as  well  as  the reasonable  cost  of  collection,  including  any  attorney  fees.  Having been advised and understanding the service technician will be as careful as possible in undertaking the repairs, I hereby  release  Appliance Services  Club,  LLC.,  its  successors  in  interest;  its  past,  present  ad future  owners, officers,  directors,  agents,  employees,  technicians, insurers,  reinsurers  and  assign  for  any  and  all  liability, actual, express and  implied,  of  damages,  damage  costs  or  expenses of  any  kind arising  out  of  and  in  the course  of  Appliance  Services  Club,  LLC., its agents  or  employees  undertraining  to  repair  any  or  all  of  your appliances.

10. Additional Terms &Conditions:

Customer agress to sumit the courts in Miami Dade County Florida in case of any controversy arising out of  this agreement.

Appliance Services Club Membership

This agreement is between APPLIANCE SERVICES CLUB (ASC) and member. The member agrees to pay the membership fee for the specific plan and return service agrees to perform the scope of work as follows:

A. APPLIANCES PLANS

The appliance plan covers the service call for 7 home appliances, regardless of the age, make of model of the appliance. The appliances covered are:

Refrigerator  
Stove/Oven/Cooktop 
Dishwasher 
Microwave 
Washer 
Dryer 
Garbage Disposal

There are two basic plans described as follows:

ANNUAL BASIC PLAN

 For $119.99 per year, the annual basic plan covers the following services:

1.- Unlimited free service calls for your seven home appliances covered. 
2.- Free estimates. 
3.- One Free annual visit from one of our technicians to check on the funtionality of the seven major home appliances. 

ANNUAL PREMIUN PLAN

 For $199.99 per year, the annual premiun plan covers the following services:

1.- Unlimited free service calls for your seven home appliances covered. 
2.- Free estimates. 
3.- One Free annual visit from one of our technicians to check on the funtionality of the seven major home appliances. 
4.- One annual cleaning service for one covered appliance. 
5.- Received discount offers.

B. PAYMENTS

All payments are payable in advance by credit card..

C. EXCLUSIONS

Our  plans  do  not  cover  the  repair  or  replacement  of  parts  and components of  appliances  thet  malfuntion due to certain causes, such as normal wear and tear.

D. TERMS AND CONDITIONS OF CLUB MEMBERSHIPS:

1.-  FIRST YEAR CLUB MEMBERSHIP

First year Club Membership terms begins on the date stated on your agreement and continues for one year ( unless ASC approves an alternative agreement term in writing) and all plan fees are received by ASC.

 2.-  RENEWAL CLUB MEMBERSHIP

Renewal Club Membership is an existing ASC customer whose agreement ASC has offered to renew. This Agreement term begins upon the expiration of the previous term and continues for one year (unless ASC 
approves an alternative agreement term in writing) provided the plan fee is received by ASC within 30 days after expiration.

E. CANCELLATION POLICY:

1.- This agreement nay be cancelled by ASC fir the following reasons:

  • Nonpayment of Club membership fees or other breach of contract by customer.
  • Fraud or misrepresentation by the customer and/or customer representative of facts material to ASC’ s issuance of this agreement or a change in law or regulations that has a material effect on the business of ASC or ASC’ s ability to fulfill its regulations under this agreements.
  • Within 30 days following the beginning of the agreement term provided customer mails a letter certified mail return receipt requested requesting cancellation. Failure to send letter by certified mail within the 30 days will cause the contract to be effective and enforceable and non-cancelable;
  • If the customer or ASC cancels the agreement  within the first 30 days following the beginning of the agreement term:
  • If ASC has not provided any cleaning services (premiun plan)  within the first 30 days of the plan membership, customer will receive a fill refund of all contract fees paid: or If ASC has not provided any technicians after 24 hours of receiving a service call.
